Article 1. applicability
1.1 The general terms and conditions apply to all products that you purchase on Optics-World B.V. finds.
1.2 Deviations from the general terms and conditions may be made by Optics-World B.V. be recorded in writing.
1.3 When placing an order you agree to the terms and conditions of Optics-World B.V..
1.4 Optics-World B.V. is not liable for any (interim) price changes. Any typing errors in the system do not guarantee delivery of products.
1.5 Some products are only available for governments, always inquire before placing your order whether the product can be delivered to private individuals.
1.6 You must check yourself whether the ordered products are permitted in your country, we deliver in accordance with Dutch law and are not responsible for any confiscation or fines. Always check whether you are allowed to import the product (with or without a permit).
Article 2. conclusion (and termination) of the agreement
2.1 An agreement with Optics-World B.V. is established when an order confirmation is sent by e-mail to the e-mail address provided by the customer. It is not important whether the order was placed via the website or by telephone.
2.2 The customer can cancel his order within 24 hours of the placement date, by send an email to info@Optics-World.nl.
2.3 The product may be returned by a consumer up to a maximum of fourteen days after purchase (= invoice date) if the packaging and product are in their original condition and not damaged. Order costs (max 50% of the invoice value) will be deducted for this. The remainder will be refunded to the buyer. The return costs are for your own account and returning is at your own risk.
2.4 When Optics-World B.V. has ordered a product that has been specially ordered by the customer and is not common, Optics-World B.V. determine that you will receive a voucher for the amount due, or that you cannot return the product. This also applies to an open order, if it has been specially ordered on request it cannot be canceled. This also applies to Flir products (this is because an STA has been signed for this) and products for which an export license has been applied for or issued.
2.5 There is also no right of withdrawal or legal reflection period for business purchases (B2B), i.e. purchases made by entrepreneurs. They therefore have no legal option to return their purchase within 14 days without giving reasons and to receive their full purchase amount including delivery costs back. They also cannot cancel orders that were ordered as a business purchase.
2.6 The return costs are for your own account and returning is at your own risk.
Article 3. prices, products, offers
3.1 All prices on Optics-World B.V. are in euros and include VAT, and exclude disposal fees and shipping costs.
3.2 Products (and special offers) are available (valid) while stocks last.
3.3 Products remain the property of Optics-World B.V. until receipt of payment for the same product.
3.4 For products for which no price is stated, the following conditions apply: these products are sold exclusively to governments and the price is offered individually per request/order upon request.
3.5 Offers or special promotions and demo models cannot be returned.
3.6 The lowest price guarantee (in accordance with the banner on the product pages) applies to identical items exclusively from the Swarovski Optik and Kahles brands. The supplier/competitor must at all times be an officially recognized dealer within Europe of the Swarovski Optik/Kahles brands. To us, identical means that the manufacturer, type designation, etc. are identical or all specified properties of the item are identical.
When a prize from Optics-World B.V. is compared with that of a competitor, both must be (or have been) valid at the same time. The competitor's price must be (or have been) valid for at least one day.
Article 4. payment
4.1 For orders via Optics-World B.V. can be paid in the following way: by bank or giro in advance. And via PayPal in accordance with the then applicable rates. Optics-World B.V. does not accept cash payments.
4.2 Shipping costs are borne by the customer, these are: - delivery by DPD and DHL at the then applicable rates.
4.3 Unless otherwise stated, the buyer is obliged to pay the invoices within 30 days of the invoice date without deduction of any discount. Settlement with any claim against the seller is excluded.
4.4 If the invoice amount expressly includes a credit restriction surcharge, this is deemed to be part of the invoice amount and may only be deducted if the remainder of the invoice has been paid within 30 days of the invoice date.
4.5 If the buyer does not pay the invoice amount due on time, he owes the seller interest of 1 ¼% of the invoice amount for each month or part thereof by which the payment term is exceeded.
If at any time the statutory interest under Article 6: 119 a. of the Dutch Civil Code is higher than the interest due under the interest clause included in this paragraph, the seller is entitled to claim the interest under Article 6: 119 a. of the Dutch Civil Code, whereby the interest will be calculated in the manner indicated in the aforementioned article.
4.6 Only payments that have been made in the manner indicated by the seller are valid. The seller is free to write off payments received by him against the outstanding costs, the interest accrued and on the oldest outstanding invoices, even if the buyer has indicated that a payment is intended to be written off against a specific invoice or the amount transferred shows that buyer intended to pay a specific invoice.
4.7 If the buyer is in default because the payment term has expired, the seller is entitled to legally collect the amount due to him, without any further reminder for payment being required.
The seller has the right to terminate all agreements concluded with the buyer if the buyer does not fulfill the obligation under an agreement concluded with the seller, if the buyer is granted a suspension of payments, or if the buyer is declared bankrupt. The seller hereby invokes his right of ownership.
4.8 In addition to the amount due, the seller is entitled to claim from the buyer all costs caused by non-payment by the buyer, both judicial and extrajudicial collection costs.
4.9 Extrajudicial collection costs are payable by the buyer in any case in which the seller has secured the assistance of a third party for collection. They amount to 12% of the amount to be claimed, being the invoice amount plus the accrued interest in accordance with paragraph 3 of this article, with a minimum of . € 11.50 If the buyer pays the principal sum, plus accrued interest and extrajudicial collection costs, within 14 days after the written reminder for payment has been sent to him by a third party to whom the seller has instructed the collection, then the extrajudicial collection costs amount to 5% of the amount due, being the invoice amount, plus the accrued interest in accordance with paragraph 3 of this article, with a minimum of € 11.50.
4.10 The seller is not obliged to demonstrate that he has incurred extrajudicial collection costs. If the seller applies for bankruptcy of the buyer, the latter will also owe the costs of the bankruptcy application in addition to the amount owed and the associated judicial and/or extrajudicial costs.
Article 5. delivery and delivery time
5.1 Orders will be delivered as quickly as possible. Optics-World B.V. strives to deliver the placed order within 7 days (only applicable to stock products), if the product is not in stock and must be specially ordered, we depend on the delivery time of the manufacturer and/or supplier, for products with an export restriction applies to Optics-World B.V. to apply for an export permit from Customs (CDIU), Optics-World B.V. has no influence on the duration of the issuance of the export permit, which can take up to 12 weeks.
5.2 As soon as the products to be delivered have been collected, the transport risk passes to the customer.
5.3 Optics-World B.V. delivers in accordance with Dutch law. And supplies products that are permitted in the Netherlands. Optics-World B.V. is not responsible for the possible ban of our products in your country. You are responsible for checking whether the products are permitted in your country. You cannot recover any damages from us. You cannot recover damages from us in the event of possible seizures, etc. You are responsible for entering your order in your destination country.
5.4 We would like to inform you that our products are prohibited for (re)sale/export to the following countries/areas mentioned in the sanctions list.
5.5 It is not permitted to (re)sell/export products manufactured in the US to countries outside the EU. This is prohibited without permission.
5.6 You are aware that upon receipt of the product and payment you are the new owner and that you will always investigate whether you may re-export the product in accordance with the laws and regulations applicable in your country.
Article 6. Returns
6.1 The product may be returned up to a maximum of fourteen days after purchase (see article 2.3), with the exception of business agreements (see article 2.5).
6.2 Refunds in the event of a returned product will take place within fourteen days.
6.3 Returns are only possible with the original invoice.
Article 7. warranty and liability
7.1 We grant the guarantee on the goods supplied by us as provided by the suppliers. After we have awarded the warranty damage, we can choose how the damage will be repaired. Namely repairing the damage, replacing the damaged part or replacing the damaged product.
7.2 If the damage is repaired, which subsequently turns out not to be covered by the warranty, the costs will be charged in full to the client.
7.3 Optics-World B.V. is never obliged to pay compensation (in any form) to the customer unless there is intent or gross negligence on the part of Optics-World B.V..
7.4 If Optics-World B.V. If you have to compensate any damage for whatever reason, this will never exceed the amount equal to the invoice value relating to the product.
7.5 There is no warranty in the following cases:
- If the wear and tear of that product can be considered normal;
- If the original invoice no longer exists, has been changed or has been made illegible;
- If defects are the result of improper use or improper use;
- If damage has been caused by intent, gross negligence, or negligent maintenance.
Article 8. Embargo countries.
We do not ship products to the following countries:
Afghanistan, Belarus, Central African Republic, Cuba, China, Cyprus (with EU part), Eritrea, Fiji, Iran, Iraq, Cote d'Ivoire, Lebanon, Libya, North Korea, Syria, Vietnam, Mali, Moldavia, Myanmar, Haiti , Liberia, Rwanda, Russia, Serbia, Somalia, Sri Lanka, Republic of the Sudan (Northern Sudan), Turkey, Tunisia, Yemen, Zimbabwe, Ukraine (only with export permit), Venezuela, Democratic Republic of the Congo. Re-export to these countries is prohibited, including (temporary) export to these countries. If there is any suspicion of onward delivery or export to the countries mentioned, we will not proceed with delivery.

Article 9. Orders outside Europe.
Optics-World B.V. does not send thermal imaging/thermal equipment (with the exception of thermal rifle scopes, which always require a permit outside the Benelux) outside Europe unless the destination is within the following countries: Australia, Canada, Japan, New Zealand, Norway, Switzerland including Liechtenstein, United States of America and United Kingdom. We have a permanent export permit EU 001 for DUAL-USE goods for these countries. These goods are always reported to Customs (DHL) via the forwarder. These goods are shipped only.
Article 10. Goods in accordance with the military goods list.
Optics-World B.V. only supplies goods classified under the military goods list within the Benelux without an export license (exemption from export regulations). Outside the Benelux, an export permit from the CDIU is always required. For this purpose, the end user must always sign an End-Use Statement. Goods that are classified in our range are thermal rifle scopes (rifle scopes with image enhancement ML1 D.) and night vision (accessories) from GEN 1 (ML15 C.). These are only shipped outside the Benelux after receipt of an export license from the CDIU. If a riflescope is specially designed for exclusively military use by the government, it may be classified as ML1 D under export regulations. These goods are only shipped.
